Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and portfx, based in Groningen, the Netherlands ("we", "us"), governing your use of the portfx iOS application ("portfx" or "the app"). By installing, accessing or using portfx you agree to these Terms. If you do not agree, do not use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use portfx on devices you own or control, subject to the Apple Media Services Terms and these Terms. You may not reverse-engineer, copy, redistribute, sublicense, resell, or attempt to extract the source code of the app, except where such restrictions are prohibited by applicable law.

2. In-app purchases and subscriptions

portfx is free to download. Optional premium features are available via:

  • portfx Premium Monthly — auto-renewing monthly subscription
  • portfx Premium Yearly — auto-renewing yearly subscription
  • portfx Premium Lifetime — one-time non-consumable purchase

All purchases are processed by Apple through your Apple ID. Prices are shown in the app and may vary by region.

Auto-renewal

Monthly and yearly subscriptions automatically renew at the end of each period unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID account is charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel your subscription at any time from your Apple ID account settings (Settings → [your name] → Subscriptions).

Introductory offers

If an introductory free trial or discounted offer applies to you, Apple will show the terms on the purchase screen. Eligibility is determined by Apple per subscription group. If you cancel during the trial, you will not be charged.

Refunds

All purchases are handled by Apple. Refund requests must be submitted through Apple at reportaproblem.apple.com.

3. Your data

You are solely responsible for the data you enter into portfx. portfx stores this data locally on your device. We strongly recommend using the built-in iCloud sync or the backup export feature to avoid loss of data. We are not liable for data loss caused by device loss, device wipe, app deletion, OS upgrade, or failure to back up.

4. Not financial advice

portfx is an informational and organisational tool. It is not financial, investment, tax, or legal advice. Exchange rates, crypto prices, logo data and calculated insights are provided "as is" and may be delayed, incomplete, or inaccurate. Always verify critical figures with your bank, broker, or a qualified professional before making financial decisions.

5. Third-party services

portfx relies on Apple (iCloud, StoreKit, APNs) and on the exchange-rate and logo services listed in our Privacy Policy. Their availability is outside our control. We are not responsible for the accuracy or continuity of third-party data.

6. Acceptable use

You agree not to:

  • Use portfx for any unlawful purpose;
  • Attempt to interfere with the app's security or integrity;
  • Use portfx to store data on behalf of another person without their consent.

7. Intellectual property

All rights, title, and interest in the portfx app, including its design, brand, logos, and source code, are and remain our property or that of our licensors. No rights are granted except those expressly set out in these Terms.

8. Warranty disclaimer

To the maximum extent permitted by law, portfx is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenues, data, goodwill, or opportunity, arising out of or in connection with your use of portfx, even if we have been advised of the possibility of such damages. Our aggregate liability arising out of these Terms is limited to the amount you paid us for portfx in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, wilful misconduct, or statutory consumer rights.

10. Termination

You may stop using portfx at any time by deleting the app. We may suspend or terminate your access to portfx, in whole or in part, if you materially breach these Terms. On termination, Sections 3, 4, 7, 8, 9 and 11 survive.

11. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws rules. Disputes will be brought before the competent Dutch courts. Consumers may additionally bring proceedings in the courts of their country of residence where mandatory law so requires.

12. EU consumer information

If you are a consumer in the EU, you have certain statutory rights that cannot be waived. Nothing in these Terms limits those rights. The European Commission's online dispute-resolution platform is available at ec.europa.eu/consumers/odr.

13. Changes

We may update these Terms from time to time. Material changes will be announced in the app or on this page with a new "Last updated" date. Continued use of portfx after a change constitutes acceptance of the updated Terms.
